Changes to These Terms
From 20 September 2026, these Terms will change as set out below. We have revised section 1 (Scope) so that these Terms also cover your use of this website and your purchases from this website. No other provisions have changed.

1. Scope

These Terms govern your use of applications (the “App”) provided by NCAT LLC (“we”). By using the App you agree to these Terms.

2. Prohibited Conduct

• Violating laws or public order
• Modifying, reverse engineering or gaining unauthorised access to the App
• Submitting scores or manipulating leaderboards by improper means
• Infringing the rights of us or of third parties
• Interfering with the operation of the App

The prohibition on reverse engineering does not apply where it may not lawfully be excluded, including where decompilation is necessary to achieve interoperability under European Union law.

3. In-App Purchases

The App includes paid in-app purchases. Purchases and refunds are handled under the terms of Apple Inc. Purchased content can be restored under the same Apple ID.

4. Advertising

Some of our apps display advertising and some do not. We are not responsible for the content of ads or for your dealings with advertisers.

5. Changes and Suspension

We may change the App, or suspend or discontinue it. Where we discontinue it, we will give notice in advance on this website or in the App unless there is a compelling reason not to. Our liability for any resulting loss is governed by section 6.

6. Limitation of Liability

We do not warrant that the App is free of defects in fact or in law.

Where loss arising from use of the App is caused by our wilful misconduct or gross negligence, we are liable for that loss.

Where it is caused by our ordinary negligence, our liability is limited to the total amount you paid us in the year preceding the event that caused the loss. This limit does not apply to death or personal injury.

7. Data

Handling of your data is governed by our separately published Privacy Policy.

8. Use of this website

Rights in the text, images, logos, video and other works published on this website (www.ncat.co.jp) belong to us or to their rightful owners. Reproducing, reposting, altering or distributing them without permission, beyond the scope of private use, is prohibited.

You are generally free to link to this website. We do decline links that defame us, that offend public order and morals, or that give the impression of an affiliation with us where none exists.

We work to keep the information on this website accurate and current, but we do not warrant that it is. Our liability for damage arising from use of this website is governed by section 6. Its contents may be changed or removed without notice.

Our contact form, telephone line and fax line exist for enquiries about our products and services. We decline contact made for sales or solicitation purposes.

9. Changes to these Terms

We may change these Terms where:

• the change is in the general interest of users; or
• the change is consistent with the purpose of these Terms and is reasonable in light of the need for it, the appropriateness of the amended content and other relevant circumstances.

Where we change these Terms, we will post the amended text and the date it takes effect on this website a reasonable period in advance. If you use the App or this website on or after that date, you are taken to have accepted the amended Terms.

10. Governing Law and Jurisdiction

These Terms are governed by the laws of Japan. Where you are a consumer, this does not deprive you of the protection afforded by the mandatory consumer-protection rules of the law of your country of habitual residence.

Any dispute between us in connection with the App or this website shall be submitted to the court having jurisdiction over our head office as the court of first instance. Where you are a consumer, this does not prevent you from bringing proceedings in the courts of your place of residence.
